Operational Framework & Rental Terms of Service

1. Criteria for Qualification & Essential Documentation

To maintain compliance with UAE transport regulations and insurance mandates, all lessees must satisfy the following criteria:

  • Age Thresholds: Standard Fleet: Minimum age of 21 years.
  • High-Performance & Exotic Fleet: Minimum age of 25 years.
  • Statutory Documentation (UAE Residents): Valid UAE Driving License (minimum 6 months tenure) and original Emirates ID.
  • Statutory Documentation (Tourists/Visitors): Original Passport, valid Visit Visa/Entry Stamp, and a valid home country license. An International Driving Permit (IDP) is mandatory for non-treaty nations.

2. Financial Indemnity & Deposit Management

  • Security Escrow: A refundable security deposit is required before vehicle dispatch. This amount is calibrated based on the vehicle’s valuation and category.
  • Reconciliation Period: Deposits are held for a maximum of 30 calendar days to facilitate the accurate reconciliation of statutory traffic fines, Salik (toll) charges, and damage assessments.
  • Deductions: Any outstanding liabilities incurred during the rental tenure will be offset against the security deposit.

3. Contractual Duration & Extension Protocols

  • Minimum Tenure: The baseline rental unit is 24 hours.
  • Late Restoration: Delays in vehicle return beyond the stipulated contractual time will result in supplemental pro-rata hourly or daily charges.
  • Extensions: Requests for tenure extension must be submitted at least 6 hours before expiration and are subject to fleet availability and rate adjustments.

4. Risk Mitigation & Liability Framework

  • Insurance Coverage: All vehicles are insured in alignment with UAE legal standards, inclusive of Third-Party Liability.
  • Supplemental Waivers: Clients may elect for Collision Damage Waiver (CDW) to minimize personal financial exposure.
  • Mandatory Reporting: In the event of any incident, an official Police Report is a condition precedent for all insurance claims. Absence of this report renders the lessee fully liable for all restorative costs.

5. Statutory Penalties & Infrastructure Tolls

  • Traffic Violations: The lessee assumes full responsibility for all speeding tickets, parking fines, and impoundment fees incurred during the term.
  • Electronic Road Tolling (Salik): Each gate crossing is recorded and charged at AED 5 per instance, to be settled upon final reconciliation.

6. Fuel Management & Refueling Protocols

  • Parity Policy: Vehicles are delivered with a specific fuel level and must be restored to the same level upon return.
  • Refueling Surcharge: Discrepancies in fuel levels will result in a refueling fee plus administrative processing charges.

7. Permissible Use & Operational Restrictions

To preserve the mechanical and aesthetic integrity of the Zirwah fleet:

  • Prohibited Activities: Off-road excursions, desert driving, drifting, track racing, and sub-leasing are strictly forbidden.
  • Olfactory Integrity: All Zirwah vehicles are strictly Non-Smoking environments. A specialized deep-cleaning fee of AED 1,000 will be levied for violations of this policy.

8. Technical Support & Emergency Response

  • 24/7 Assistance: Zirwah provides comprehensive roadside support for mechanical anomalies or emergencies.
  • Immediate Notification: Clients must report any mechanical irregularities or warning indicators immediately to prevent asset degradation.

9. Cancellation & Refund Governance

  • Standard Cancellation: Eligible for a full refund if initiated 24 hours before the commencement of the term.
  • Late Cancellation: Subject to a fee equivalent to one full day’s rental.
  • Early Termination: No pro-rata refunds are issued for assets returned before the contractual expiration.

10. Logistics, Delivery, and Handover

  • Complimentary Zones: Delivery and collection services are available within designated areas of Dubai.
  • Premium Logistics: Deliveries to other Emirates or international transport hubs (Airports) may incur supplemental logistical fees.
  • Verification: The primary lessee must be physically present at handover to execute the delivery inspection report.

11. Authorized Operators & Supplemental Drivers

  • Exclusivity: Only individuals explicitly listed on the Rental Agreement are authorized to operate the vehicle.
  • Additional Drivers: Supplemental operators must provide valid documentation and may be subject to a nominal administrative fee.

12. Asset Integrity & Damage Indemnification

  • Uninsured Loss: The lessee is liable for any loss not covered by the insurance policy, including interior damage, tire punctures, and underbody impacts resulting from misuse.
  • Repairs: All repairs must be conducted via Zirwah’s authorized service centers. Unauthorized third-party maintenance is prohibited.

13. Jurisdictional Governance & Legal Framework

  • Governing Law: These terms are governed by the federal laws of the United Arab Emirates.
  • Jurisdiction: Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Dubai Courts.
